The Sponsor
The Sponsor is Active Capital Ltd. (the “Sponsor”). -
The Promoter
The Promoter is Blackbeards Trading Company Limited (the “Promoter”)
(collectively, the Sponsor and Promoter are referred to as the “Organisers”) -
The Promotion
3.1 The title of the promotion is the the Blackbeard’s Christmas Scratch & Win Promotion (the “Promotion”). The Promotion is governed by these official rules (the "Official Rules").
3.2 The Promotion will run from Monday 1st December 2025 to Wednesday 31st December 2025 (the “Promotion Period”) inclusive at the Participating Retailers (defined below).
3.3 The Promotion is a scratch card-based competition where customers spending CI$50 in-store will receive a scratch card to see if they have won an Instant Prize (as defined below).
3.4 Participating Retailers include include Anchors, Blackbeard’s Camana Bay, Blackbeard’s Grand Harbour, Blackbeard’s Eastern Avenue, Blackbeard’s Outlet, Blackbeard’s Falls and Blackbeard’s Brac (the “Participating Retailers”). 3.5 By entering and participating in the Promotion, each person (the "Entrant") agrees to comply with these Official Rules, including all eligibility requirements, and acknowledges that the results of the Promotion, as determined by the Sponsor and its agents, are final and binding in all respects.
3.6 The Promotion is subject to all applicable laws and regulations of the Cayman Islands and is void where prohibited by law. -
Scratch Cards
4.1 The Blackbeard's scratch card promotion is intended solely for entertainment purposes.
4.2 Scratch cards are distributed only while supplies last.
4.3 All potential winning entries are subject to verification and approval by the Organisers.
4.4 Participants must carefully remove the scratch-off surface to determine if they have won a prize.
4.5 No more than the scheduled number of prizes will be awarded under any circumstances, including but not limited to human or programming errors in the production or distribution of scratch cards.
4.6 Available instant win prizes and the odds of winning are subject to change without notice.
4.7 The Organisers are not responsible for lost or damaged scratch cards. Any scratch card that is damaged, destroyed, lost, duplicated, fraudulent, or tampered with in any manner is void and ineligible for prize redemption.
4.8 Any scratch card that is defective or contains printing, typographical, mechanical, or human errors in production is void. Entrants in possession of a defective or erroneous scratch card may be eligible for a replacement scratch card, subject to the Organisers’ approval.

How to Enter
5.1 The competition will run from Monday 1st December 2025 to Wednesday 31st December 2025 (the “Promotion Period”) inclusive at the Participating Retailers.
5.2 To enter the competition:
(a) Spend a minimum of CI$50 in-store, which can be spent on any items available for purchase, to receive a scratch card. Entrants will receive one (1) Blackbeard’s branded scratch card per CI$50 spent. Scratch the card to see if you have won an Instant Prize (as defined below).
(b) From Monday, 1 December 2025 to Sunday, 7 December 2025, entrants will receive two (2) scratch cards for every CI$50 spent.
5.3 The Organisers will not accept responsibility for scratch cards or receipts that are lost, mislaid, damaged, or delayed, including as a result of technical failure.
6. Eligibility
6.1 The promotion is open to all individuals aged 18 years or over. Both residents and non-residents of the Cayman Islands who are aged 18 or over may receive a scratch card upon spending CI$50 in-store to reveal if they have won an Instant Prize.
7. The Prizes
7.1 The details of the Instant Prizes available, along with the applicable prize terms, are outlined in Schedule 1 (singly the “Instant Prize, collectively the “Instant Prizes”).
7.2 Instant Prizes are subject to availability and non-refundable and non-transferable. There is no cash alternative for the Instant Prizes. The Organisers reserve the right to substitute any of the Instant Prizes with a prize of equal or lesser value.
7.3 Notwithstanding the above, additional terms and conditions may apply to the respective prizes. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules, and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the Prize winner.
7.4 Any and all applicable taxes and/or duties associated with the receipt or use of any prize shall be solely the responsibility of the respective winner.
8. Claiming Instant Prizes
8.1 Winners are solely responsible for collecting the Instant Prizes from the store where their scratch card was issued. Instant Prizes can be redeemed immediately upon verification.
8.2 To claim an Instant Prize, winners must present the card, to a staff member at the store where the scratch card was issued. URN (Unique reference number) code on the front of the scratch card will showcase where the card was issued by having a 2-letter indication of the store:

8.3 Scratch cards will only be issued until 10pm on 31st December 2025 and all Instant Prizes must be claimed by 15th January 2026.
8.4 Photo identification may be required to claim an Instant Prize, along with any additional documentation or evidence requested by the Organisers.
9. Indemnification and Limitation of Liability
9.1 By participating in the Promotion, each Entrant agrees to fully indemnify, release, and hold harmless the Organisers and their parent, affiliate, and subsidiary companies, administrator, advertising and promotional agencies, and all their respective officers, directors, employees, representatives, and agents from any and all liability, claims, demands, damages, losses, or injury resulting in whole or in part, directly or indirectly, from that Entrant’s participation in the Promotion and the provision, acceptance, use, or misuse of the prizes that may be won, including but not limited to any injury such as paper cuts from handling the scratch card, or any alcohol-related injuries or conditions, including alcohol poisoning or relapse for individuals with a history of alcohol addiction. This includes any claims arising from the use of any information that may be considered private.
9.2 The Organisers and their parent, affiliate, and subsidiary companies do not make any warranties, express or implied, as to the condition, fitness, or merchantability of the prizes. The Organisers and their parent, affiliate, and subsidiary companies, advertising and promotional agencies, and all their respective officers, directors, employees, representatives, and agents disclaim any liability for damage to any computer system resulting from access to or the download of information or materials connected with the Promotion.
10. Data Protection and Publicity
10.1 By entering this Promotion participants understand and consent to, that in the event they win an Instant Prize, the Organisers may collect, use and publish their names, photographs and/or likenesses for the purpose of publicising the Promotion, including but not limited to showcasing winners on social media and announcing recipients of specific Instant Prizes, and related promotional activities. Participants understand that such personal data may also be shared with third parties and/or affiliates of the Organisers that deliver services to the Organisers in connection with the Promotion. 11. General
11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Organisers may, at their sole discretion, disqualify any entry.
11.2 The Organisers reserve the right to terminate, suspend, or amend the Promotion, including amending the Official Rules, without notice and for any reason, including but not limited to circumstances where the Promotion cannot be conducted as planned, or if a virus, bug, tampering, unauthorized intervention, technical failure, or other cause beyond the Organisers’ control corrupts the administration, security, fairness, integrity, or proper play of the Promotion.
11.3 All prizes are non-transferable, non-refundable and Instant Prizes may not be resold.
11.4 Instant Prizes are must be stored and used responsibly.
11.5 The Organisers and their respective parent, affiliate, and subsidiary companies, agents, and representatives, along with their respective employees and agents (collectively, the “Affiliated Entities”), are not responsible for any typographical or other errors in the offer or administration of the Promotion, including but not limited to errors in printing, posting these Official Rules, selecting or announcing winners, or distributing the Prize.
11.6 Any attempt to damage the content or operation of this Promotion is unlawful and may result in legal action by the Organisers.
11.7 In the event of tampering or unauthorized intervention, the Organisers reserve the right to void any suspect entries.
11.8 The Organisers and the Affiliated Entities are not responsible for incorrect or inaccurate transcription of entry information or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure, or malfunction of any telephone network, computer equipment, or software, or the inability to access any website or online service.
11.9 The Organisers reserve the right to extend or shorten the Promotion Period at its sole discretion.
12. Publicity
By participating, each Entrant grants the Organisers the right to use their name or image in connection with Blackbeard's promotions, including on social media and other platforms for promotional purposes, marketing campaigns, or advertising, in any medium now known or developed in the future (including Organiser-owned or sponsored websites, Facebook, Twitter, Instagram, and YouTube), without additional compensation, except where prohibited by law.
13. Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the Cayman Islands. The Courts of the Cayman Islands shall have exclusive jurisdiction over any dispute arising out of or in connection with this promotion.
